A defendant in Grenada County has filed an interlocutory appeal presenting a consolidation issue.
In August of 2012, Ronnie Willis filed a lawsuit against two defendants, Lindsay S. Taylor and Bennie Bailey, over two separate auto accidents. The one involving Taylor occurred on May 10, 2011 and the second, involving Bailey, occurred on September 9, 2011. Taylor filed a motion to sever on the grounds of misjoinder several weeks after the lawsuit was filed. It was granted. After discovery had taken place, co-defendant Bailey filed a motion to (re)consolidate for purposes of discovery and trial. It was granted. On October 17, 2014, Taylor filed the interlocutory appeal.
Apparently Willis is complaining of lower back pain and mild numbness to his left lower leg from both accidents. We will see if this is something the appeals court elects to address.
